What is a Retrospective Agreement?

A retrospective party wall agreement is used when construction or renovation work that affects a party wall or boundary has already started—or has even been completed—without first following the procedures set out in the Party Wall etc. Act 1996.

While this situation is more common than many people realise, it can still be resolved. The building owner and the adjoining owner(s) can work together to formalise the necessary documentation after the work has begun. This is known as a retrospective party wall agreement, and it provides a structured, professional way to regularise the works and protect both parties moving forward.

Creating a retrospective agreement typically follows the same steps as the standard party wall process. This may include issuing the appropriate notices, appointing surveyors if required, and recording the agreed terms relating to the works that have already taken place.
